Terms of Service

Fat Heron is operated by DataMossa Co., Ltd., a company incorporated in Thailand, trading as Fat Heron.

Fat Heron provides personality-based, novelty, funny, satirical, rude, political, sport-related, lifestyle, and other custom email addresses using domain names owned, controlled, or managed by us.

For example:

yourname@ExampleDomain.com

When you buy an email address from us, you are buying the right to use that specific email address for as long as your subscription remains active and you follow these Terms.

You are not buying the domain name itself.

The domain name remains owned, controlled, or managed by Fat Heron or its operator.

Depending on the service offered, your email address may include one or more of the following:

• email forwarding to an inbox you choose
• the ability to send email from your new address using SMTP settings
• webmail access
• mailbox access
• setup instructions for Gmail, Outlook, Apple Mail, or other email apps

The exact features available may depend on the domain, plan, provider, and setup chosen.

We may update, change, improve, restrict, or replace the technical setup of the service where needed.

Email addresses are offered on a first come, first served basis.

We do not charge extra purely for popular first names unless clearly stated on the checkout page.

Once an address has been claimed, such as steve@ExampleDomain.com, it is no longer available unless it is later released, cancelled, expired, or made available again by us.

We do not guarantee that any specific name will be available.

Email addresses may be sold as monthly, annual, lifetime, promotional, or other plans, depending on what is shown at checkout.

You agree to pay the price shown at checkout.

Payments may be processed by Stripe or another payment provider.

If your plan renews automatically, you authorise us and our payment provider to charge your chosen payment method at each renewal period until you cancel.

You are responsible for keeping your payment details up to date.

If payment fails, your email address may be suspended, restricted, disabled, or released after any grace period we choose to provide.

You may cancel your subscription according to the cancellation process available through your account, payment link, customer portal, or by contacting us.

Cancelling stops future renewal charges.

Unless required by law or stated otherwise at checkout, cancellation does not automatically refund any unused part of a current billing period.

If your email address expires, is cancelled, or is suspended for non-payment, we may make it available for someone else to claim.

We do not guarantee that a cancelled, expired, or released email address can be recovered later.

Refunds are handled at our discretion unless required by law.

We may refuse refunds where:

• the email address has already been created
• the service has already been used
• the customer changed their mind
• the customer failed to set up their own email app correctly
• the customer breached these Terms
• the customer used the service for spam, abuse, fraud, impersonation, or illegal activity

Where we discontinue a domain or service that affects your active paid email address, we may offer a replacement address, account credit, or a refund for the unused part of your paid subscription period.

You are responsible for how your email address is used.

You agree not to use, attempt to use, or allow anyone else to use your email address for:

• spam
• phishing
• scams
• fraud
• malware
• viruses
• illegal activity
• bulk unsolicited email
• automated mass messaging
• harassment
• threats
• abuse
• stalking
• hate speech
• doxxing
• targeted intimidation
• impersonating another person, business, organisation, public figure, government body, charity, or brand
• misleading people about who you are or who you represent
• collecting sensitive information from others under false pretences
• sending content that breaches another person’s privacy, rights, intellectual property, reputation, or legal protections
• signing up for services in a way that causes complaints, abuse reports, blacklisting, or damage to our domains, systems, payment accounts, hosting accounts, or email reputation
• any activity that may cause Fat Heron, our domains, our hosting provider, our email provider, our payment provider, or our other users to be suspended, blocked, blacklisted, restricted, investigated, or penalised

You must not use your email address to pretend to be someone else.

This includes impersonating:

• a private person
• a celebrity
• a politician
• a sports figure
• a company
• a public authority
• a charity
• a brand
• a social media account
• a support team
• a bank or financial service
• a medical service
• a legal service
• any other person or organisation you are not authorised to represent

Humour, satire, parody, and sarcasm are allowed only where they do not mislead people, break the law, breach rights, or create risk for Fat Heron.

Some of our domain names may be rude, sarcastic, political, satirical, controversial, or intended as humour.

You understand that the tone of a domain name does not give you permission to use the service for abuse, harassment, threats, hate speech, scams, impersonation, or illegal activity.

We reserve the right to refuse, suspend, or remove any email address that we believe creates legal, reputational, technical, payment, provider, or abuse risk.

We may suspend, restrict, disable, or terminate any email address or account immediately, with or without notice, if we believe:

• you have breached these Terms
• your account has been used for spam, phishing, fraud, scams, abuse, impersonation, or illegal activity
• your account creates risk for our domains, mail servers, payment account, hosting account, email reputation, or other users
• we receive abuse complaints
• we are required to act by a hosting provider, email provider, payment provider, regulator, law enforcement authority, court, or other relevant party
• continuing the service may cause harm to Fat Heron or others

Where an account is suspended or terminated for abuse, fraud, spam, illegal activity, impersonation, serious misuse, or breach of these Terms, no refund will be given.

We will make reasonable efforts to provide a working email service.

That said, email delivery can never be guaranteed.

Delivery may be affected by:

• spam filters
• recipient inbox rules
• DNS settings
• email provider restrictions
• sender reputation
• forwarding behaviour
• third-party outages
• incorrect setup by the user
• security checks
• blacklists
• rate limits
• technical issues outside our control

We do not guarantee that every email will be delivered, received, forwarded, accepted, or shown in the recipient’s inbox.

We may provide setup instructions for Gmail, Outlook, Apple Mail, webmail, SMTP, IMAP, forwarding, or other email tools.

You are responsible for entering the correct details, keeping your password secure, and managing your own third-party email account.

We are not responsible for issues caused by incorrect setup, forgotten passwords, third-party email settings, changes made by Gmail, Outlook, Yahoo, Apple, or any other external provider.

You are responsible for keeping your password safe.

You must not share your password with anyone who is not authorised to use your email address.

You must contact us immediately if you believe your email address, forwarding address, password, or account has been compromised.

We may reset, restrict, or suspend access where we believe there is a security risk.

We may apply fair use limits to protect our domains, systems, providers, and users.

Limits may include:

• sending limits
• forwarding limits
• storage limits
• attachment limits
• mailbox limits
• abuse complaint limits
• account creation limits
• technical restrictions set by our hosting, email, or infrastructure providers

We may change these limits at any time to protect the service.

The service is intended for normal personal, novelty, identity, and light business-style email use. It is not intended for bulk sending, cold outreach, marketing blasts, automated email systems, or high-volume sending.

We may add, remove, retire, transfer, sell, or discontinue any domain name used by the service.

If we discontinue a domain that affects your active paid email address, we will make reasonable efforts to notify you and may offer one of the following:

• an alternative email address
• account credit
• a refund for the unused part of your paid subscription period

We are not responsible for loss of branding, personal preference, business cards, printed materials, social handles, or other uses connected to an email address if a domain is discontinued, suspended, transferred, or retired.

We may introduce a marketplace, trading page, resale system, transfer system, or premium name system in the future.

Until such a system is officially launched, email addresses cannot be sold, transferred, sublet, assigned, or traded without our written approval.

We may refuse transfers or trades for any reason, including abuse risk, impersonation risk, legal risk, payment risk, or brand protection.

Our service may rely on third-party providers including hosting companies, email providers, DNS providers, payment processors, analytics tools, security tools, and customer support tools.

We are not responsible for outages, errors, delays, suspensions, restrictions, or policy changes caused by third-party providers.

You agree to follow any relevant terms, rules, or restrictions required by those providers.

Payments may be processed by Stripe or another payment provider.

You agree not to use our service in a way that breaches the rules of our payment providers.

We may suspend or terminate any account if required by our payment provider or if your use creates payment risk, chargeback risk, fraud risk, or compliance risk.

If you open a chargeback or payment dispute, we may suspend or restrict your email address while the dispute is reviewed.

Fraudulent chargebacks, abusive disputes, or repeated payment issues may lead to termination of your account.

We collect and use personal information to provide the service, process payments, manage accounts, deliver support, prevent abuse, and comply with legal or provider requirements.

Personal information may include your name, contact email, chosen email address, forwarding address, payment status, subscription details, support messages, technical records, and abuse reports.

To report abuse involving a Fat Heron email address, contact:

Please include the email address involved, a description of the issue, and any relevant evidence such as message headers, screenshots, dates, or full email content.

We may investigate abuse reports and take action where we believe it is necessary.

You may not resell, rent, lease, share, transfer, or provide your email address to someone else without our written approval.

You remain responsible for all activity connected to your email address.

We aim to keep the service available, but we do not guarantee uninterrupted service.

The service may be interrupted by maintenance, updates, provider issues, technical faults, DNS changes, security incidents, abuse controls, or events outside our control.

We may change, update, suspend, replace, limit, or discontinue any part of the service at any time.

Where a material change affects active paid customers, we will make reasonable efforts to notify them by email or through the website.

We may update these Terms from time to time.

The updated version will be posted on our website with a new “Last updated” date.

Continued use of the service after changes are posted means you accept the updated Terms.

To the maximum extent allowed by law, Fat Heron, its operator, owners, contractors, providers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages.

This includes loss of profits, lost emails, missed messages, lost opportunities, loss of reputation, business interruption, loss of data, service outages, or email delivery failures.

Our total liability to you for any claim connected to the service will not exceed the amount you paid us in the 12 months before the claim arose.

You agree to protect and compensate Fat Heron, its operator, owners, contractors, providers, and partners from any claims, losses, damages, costs, legal fees, provider penalties, payment disputes, abuse complaints, or investigations arising from:

• your use of the service
• your breach of these Terms
• your misuse of an email address
• your violation of any law or third-party right
• your spam, fraud, abuse, impersonation, or illegal activity
• any content sent, received, forwarded, or handled through your email address

These Terms are governed by the laws of Thailand.

Any disputes will be handled by the courts of Thailand, unless applicable law requires otherwise.
